1. Agreement to Terms
These Terms & Conditions ("Terms") constitute a legally binding agreement between you (whether individually or on behalf of an entity, "you" or "Member") and OUT OF THE BOX ("we", "our", or "us"), concerning your access to and use of the outofthebox mobile application (package: com.outofthebox), our official website (https://outoftheboxcoworking.in), and our physical coworking premises, serviced offices, meeting rooms, and shared workspaces.
By registering an account, purchasing a membership pass, or utilizing any of our premises or digital services, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you must immediately discontinue use of our mobile app and premises.
2. Eligibility & Account Responsibilities
- Age Requirement: You must be at least 18 years old to create an account and book workspace facilities.
- Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. You agree to notify us immediately of any unauthorized access or security breach.
- Accurate Information: You agree to provide true, accurate, and current profile and contact details during registration and to update them whenever changes occur.
3. Space Access & Community Code of Conduct
OUT OF THE BOX thrives on fostering a collaborative, respectful, and productive work environment. All members and their guests agree to abide by our Code of Conduct:
- Professional Demeanor: Members must conduct themselves professionally, treat staff and fellow coworkers with mutual respect, and refrain from abusive, disruptive, or discriminatory behavior.
- Noise & Phone Calls: High-volume speakerphone calls and noisy meetings are strictly confined to designated phone booths or booked meeting rooms. Open work areas require headphones and moderate voice levels.
- Clean Desk & Common Spaces: Hot-desks and shared amenities (pantries, lounges, restrooms) must be kept clean after each use. Personal belongings must not be left unattended on flexi-desks overnight.
- Prohibited Items: Hazardous substances, illegal drugs, weapons, combustible materials, and unauthorized electrical heating equipment are strictly prohibited across all facilities.
- Smoking & Alcohol: Smoking, vaping, and consumption of unauthorized alcoholic beverages are strictly prohibited on the premises.
4. Bookings, Payments, & Subscriptions
- Advance Reservations: Desks, private cabins, and conference rooms must be reserved in advance via the outofthebox mobile application or admin booking desk.
- Pricing & Taxes: All stated prices are in Indian Rupees (INR) and are exclusive of applicable Goods and Services Tax (GST) unless explicitly indicated otherwise. Applicable taxes will be calculated at checkout.
- Payment Terms: Monthly office subscriptions and prepaid flexi-plans are billed in advance. Services will be activated only upon confirmation of full payment through our authorized payment gateways.
- Overstay & Extended Usage: Meeting rooms and desks must be vacated promptly at the conclusion of the booked slot. Overstaying beyond your scheduled reservation may incur automated overtime charges billed at the standard hourly rate.
5. Cancellation & Refund Policy
- Meeting Room & Day Pass Cancellations: Cancellations made at least 24 hours prior to the scheduled start time are eligible for a 100% credit refund to your in-app account balance. Cancellations made within 24 hours of the booking slot are non-refundable.
- Monthly & Dedicated Desk Subscriptions: Cancellation of long-term subscriptions requires written notice of at least 30 calendar days before the renewal date. Security deposits, if applicable, will be refunded within 15 business days after final checkout inspection and clearance of outstanding dues.
- No Cash Refunds: Approved short-notice refunds are generally issued as workspace usage credits or refunded to the original payment source within 7-10 banking business days.
6. Internet & Technology Usage Policy
- High-Speed Wi-Fi: High-speed internet is provided for legitimate professional and business activities.
- Prohibited Network Activities: You may not use our network for torrenting, distributing copyrighted content without authorization, spreading malware, attempting unauthorized penetration of network hosts, or transmitting illegal material.
- Fair Usage: Excessive network bandwidth consumption that impedes fellow members' connectivity may result in speed throttling or connection suspension.
7. Guests & Visitor Policy
- Members with valid meeting room reservations may host visitors for the duration of the booked meeting.
- All visitors must register at the reception desk and provide valid photo identification upon arrival.
- Hosts are strictly responsible for their guests’ conduct and compliance with our community guidelines while on the premises.
8. Property, Security, & Lost Items
- Personal Property: OUT OF THE BOX is not liable for any lost, stolen, damaged, or misplaced personal belongings, electronic devices, or documents left on the premises. Members are advised to use private lockers or take valuables with them.
- CCTV Surveillance: For the safety and security of all occupants, common areas, entrances, and hallways are monitored 24/7 by closed-circuit television (CCTV) cameras. Private cabins and restrooms are not subjected to internal camera surveillance.
9. Limitation of Liability
To the maximum extent permitted by applicable law, OUT OF THE BOX, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business goodwill, resulting from:
- Temporary interruption of internet connectivity, electrical power, or air conditioning caused by utility providers or force majeure events.
- Actions, disputes, or conduct of any other coworker, member, or guest.
- Unauthorized access or alteration of your transmissions or data.
10. Suspension & Termination
We reserve the right to suspend or terminate your membership and revoke access to the outofthebox mobile application and facilities immediately, without prior notice or refund, if you:
- Breach any material provision of these Terms & Conditions.
- Engage in illegal, violent, harassing, or fraudulent behavior on the premises.
- Fail to pay membership dues after formal notice.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any legal dispute, controversy, or claim arising out of or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the competent courts in Hyderabad, Telangana, India.
